TERMS AND CONDITIONS

Unfortunately, like all companies we need to have 'small print' to protect us against the minority of people who may try to take advantage. We believe that the terms and conditions are fair, however, if you disagree, please do not purchase anything at all from us!

This site is intended to be informative however we cannot be held responsible for errors, omissions or information which may be inaccurate or out of date. It is your responsibility to ensure you order the parts or systems you require. For DIY installations we merely supply components that you have specified and we cannot become involved in designing systems or providing advice after you have bought those components.

GENERAL

•All goods are sold 'ex- works'. This means that the costs of transporting the goods to and from our premises is the sole responsibility of the customer. If necessary we can organize transportation on behalf of the customer (by prior arrangement).

GUARANTEE

All goods are guaranteed for 12months against defects in workmanship with the exception of petrol and diesel generating sets which are guaranteed for 3months, unless otherwise specified. The guarantee covers replacement of faulty parts (or refund, at the discretion of essentialspark.com), and does not cover any aspect of consequential loss. essentialspark.com denies all responsibility for all consequential losses.
In the event of a component failure due to faulty components or workmanship, the component will be replaced free of charge during the guarantee period only. The cost of shipping the faulty part back to essentialspark.com, and the cost of shipping the replacement part out to the customer is the responsibility of the customer. Alternatively, the customer may visit our distribution centre by arrangement to exchange the faulty unit. No exchange will be given without the return of the original part. This guarantee has specific exclusions:
•Wear and tear
•Damage due to misuse
•Petrol and Diesel Generating Sets are guaranteed for 3 months only
•Damage caused to wind turbines and electronics by exposure to high winds, or gusts exceeding the maximum design speed of the turbine. The turbines we supply are designed for high output at low wind speed, and are therefore unsuitable for high wind areas. Use of these wind turbines in coastal areas or use in other high-wind areas is at the customer's risk only.
•Damage caused to electrical components by disconnecting any component during operation. Disconnection of the inverter, batteries, charge controller or turbine whilst any component is powered/delivering power can cause irreversible damage. This type of misuse is not covered by the guarantee.
•The guarantee is automatically invalidated if any part of a system is modified (even if the modified part is not the component that has failed), unless prior agreement is obtained in writing from essentialspark.com
•Damage caused to the wind turbine or blades caused by over-spinning due to running without suitable load or battery connected
•Damage caused to wind turbine by out-of-balance hub/blades. The responsibility of balancing the blades lies with the installer, who must do so AFTER assembly
•Damage caused to wind turbine blades due to abrasion by particles carried by the wind.

No liability is accepted for any damage caused to property as a result of mechanical failure. All machinery and equipment supplied by essentialspark.com, and wind turbines in particular should be operated a safe distance from individuals and property. If you are unsure of the acceptable safe distance, please consult before setting up the equipment. The turbine should not be erected where tower failure or turbine failure can cause the machinery to fall onto cars, individuals or property. When the wind turbine is operational, no personnel should come within a distance equivalent to twice the tower height for safety reasons. Any injury caused by failing to heed these warnings will not be the liability of essentialspark.com.

essentialspark.com denies any liability for damage to any other equipment that may be used in conjunction with our products. We have no control over what equipment is used or how it may be used, and therefore we are not in a position to guarantee its safeguard.
Damage to batteries due to excessive deep discharge, short-circuiting, excessively high load, excessive charging, loss of electrolyte, failure to maintain electrolyte level, topping up using fluid other than distilled or de-ionised water or any weather condition outside of the manufacturer's specification for battery use.

FINANCIAL

1. Title to all goods and equipment remains with essentialspark.com until paid in full. essentialspark.com reserves the right to collect, dismantle and/or remove equipment and to arrange its return in the event of non-payment. In the event of non-payment or returned payment, any costs incurred by essentialspark.com in recovering its property will be the responsibility of the customer. essentialspark.com reserves the right to take all necessary steps to recover equipment that has not been paid for.
2. Goods may be returned within 28 days for a refund, if they are returned unused and in original packaging however, a return-to-stock fee of 15% will be charged. The shipping costs of transporting the equipment both ways shall remain the customer's responsibility.
3. No refund will be given for goods that have been modified, damaged, used, or returned without original packaging. No refund will be given for items that have been dismantled or have parts missing, unless by prior agreement in writing.
4. essentialspark.com does not operate any credit facilities or monthly accounts. All payments are due on or before the date of dispatch. Any overdue amount will be charged at an interest rate of 2% per month. Interest charges will be round UP to the nearest month.
5. essentialspark.com does not operate any 'sale or return' policy. This can only be arranged by prior agreement in writing.

SHIPPING

1. All goods are sold ex-works. This means that we do not accept responsibility for the security of the goods during transit. Customers should arrange their own transportation of the goods from our premises. Alternatively, we can arrange transportation at the customer's request, however there are some important points:
a. Standard insurance only is provided, unless the customer has requested otherwise in writing. Standard insurance is £2.50/kg. Any claim against essentialspark.com for loss or damage in transit is limited to this level unless additional cover has been requested in writing, agreed and paid for.
b. It is the customer's responsibility to ensure that goods are thoroughly checked for damage before signing 'received in good condition'. Failure to do so will invalidate any shipping insurance claim. essentialspark.com will not be held responsible for any insurance claim for damage where a signature has been received by the courier on delivery indicating that the goods were received in good condition
c. essentialspark.com requires that in the event of shipping damage, the customer must retain all packaging and equipment for inspection by the company and/or the courier. Failure to do so will invalidate the shipping insurance. Damaged goods must be returned to essentialspark.com at the customer's expense if they are to be replaced. No replacement or refund will be granted prior to the outcome of the courier's investigation, and will be dependant on a successful outcome.
d. A packing and processing fee supplement may be applied depending upon the size of your order, we will confirm if a charge is necessary on forwarding our price to supply specific items to you.

No reproduction of any of this information, for reward or otherwise is allowed without the prior written consent issued by essentialspark.com.

definitions:

'in writing' : postal letter, fax or hand-written notice. This does not include emails or verbal conversations
'misuse': any form of use which is not specified by essentialspark.com or the product manufacturer.

The introduction of the Distance Selling Regulations (DSR) gives the consumer the right to a 'cooling off' period of seven (7) days once they have received goods via mail order.

The 'cooling off' period is essentially a right to cancel your order for any reason and return them to us without charge.

The DSR does not cover faulty goods, used goods or goods with packaging that has been opened/damaged/lost - this will be dealt with under our normal returns procedure.

If you have received goods from us and have changed your mind, you may return them to us subject to the following conditions:

1. You must inform us within seven working days in writing (fax, letter or in person) that you are rejecting the goods.
2. The item(s) must be in new condition, unopened and without any damage to the exterior packaging.
3. The DSR do not apply to any software or goods that have been custom-made or order in specially to the customer's requirements i.e. cylinders or non-stock items.
4. The customer must bear the costs of postage including return postage to, essentialspark.com and any financial handling charges that have been incurred.

essentialspark.com will refuse any items returned if:

1. The goods have not been returned within 14 days.
2. The product packaging has been opened or seals have been broken.
Goods that are rejected due to the reasons above will be returned to the customer at their expense.
